The agreement

These Terms of Service (the "Terms") are the agreement between HostElevate, a web hosting business ("HostElevate", "we", "us" or "our"), and the individual or organisation that orders or uses our services ("you" or the "Customer"). They apply together with our Acceptable Use Policy, Privacy Policy and Refund Policy.

By ordering, paying for or using any HostElevate service, you agree to these Terms and the policies they refer to. If you accept on behalf of a business, you confirm that you are authorised to do so.

Definitions

The terms used throughout.

  1. 1.1

    "Services" means every service we provide, including web hosting, WordPress and WooCommerce hosting, reseller hosting, cloud servers, cPanel servers, domain registration, SSL certificates, email and support.

  2. 1.2

    "Account" means your client area account at billing.hostelevate.com and every Service ordered through it.

  3. 1.3

    "Content" means any data, files, websites, software, email and other material you or your users store or transmit using the Services.

  4. 1.4

    "Term" means the billing period you choose for a Service, such as monthly, yearly or longer.

  5. 1.5

    "Policies" means our Acceptable Use Policy, Privacy Policy and Refund Policy.

Your account

Keep it accurate, and keep it safe.

  1. 2.1

    You must give us accurate and complete information when you open your Account, and keep it up to date.

  2. 2.2

    You must be at least 18 years old, or the age of legal capacity where you live, to open an Account.

  3. 2.3

    You are responsible for keeping your login details secure and for all activity under your Account. Tell us immediately if you think someone has accessed it without permission. Two-factor authentication is available at no cost, and we recommend using it.

  4. 2.4

    We may ask you to verify your identity or your payment before we activate a Service, to protect you and us from fraud.

Orders, fees and payment

You pay in advance for the Term you choose.

  1. 3.1

    Fees are payable in advance for each Term. Prices are shown in US dollars, or in a local currency where we offer one, and you are charged in the currency of your invoice.

  2. 3.2

    Prices do not include taxes unless we say so. Where the law requires us to charge tax, it is added to the invoice.

  3. 3.3

    We send each invoice to your Account email address before its due date. You can pay using any payment method offered at checkout, and the payment provider's own terms also apply to that payment.

  4. 3.4

    If an invoice is not paid by its due date, we send reminders. If it remains unpaid, the Service may be suspended and, later, terminated. The reminder emails tell you when each step will happen.

  5. 3.5

    If you have a problem with a charge, please contact us before opening a chargeback or payment dispute. We may suspend the Service concerned while a dispute is open.

Renewal and pricing

No surprise at the second invoice.

  1. 4.1

    Services renew automatically at the end of each Term unless you cancel. You can turn off automatic renewal at any time in the client area.

  2. 4.2

    Your hosting renews at the renewal price published on the plan when you bought it.

  3. 4.3

    If we ever need to change a renewal price, we give you at least 30 days written notice before it applies, and you may cancel before it takes effect.

  4. 4.4

    Domain renewal prices follow the fees set by each registry. If a registry raises its fees, the renewal price of that domain may change, and we will tell you before the renewal where we can.

Refunds

Covered in full by the Refund Policy.

  1. 5.1

    Refunds are governed by our Refund Policy, which forms part of these Terms.

  2. 5.2

    In short: new web, WordPress, WooCommerce and reseller hosting is covered by a 90-day money-back guarantee. Domain registrations, transfers and renewals are not refundable, and third-party licences and certificates are refundable only where the supplier refunds us.

  3. 5.3

    Services terminated for breach of these Terms or the Acceptable Use Policy are not eligible for a refund.

Using the Services

Use them lawfully, within your plan.

  1. 6.1

    You must use the Services in line with the law and our Acceptable Use Policy.

  2. 6.2

    Each plan has the resource limits shown on it. Shared hosting is also subject to the fair-use rules in the Acceptable Use Policy.

  3. 6.3

    Software you install, such as WordPress, plugins, themes and scripts, is your responsibility to keep updated and secure. Third-party software is provided under its own licence.

  4. 6.4

    If you resell our Services, you are responsible for your own customers and for making sure they follow our Policies.

Availability, maintenance and support

What we aim for, and how we help.

  1. 7.1

    We aim for 99.9% network availability each calendar month, not counting planned maintenance announced at least 24 hours in advance. This is a target, not a promise of uninterrupted or error-free service.

  2. 7.2

    If a Service falls below that target in a month because of a fault on our side, you can ask for a service credit against a future invoice. Service credits are the only compensation for downtime.

  3. 7.3

    We carry out maintenance to keep the Services secure and up to date. Where possible we schedule it for quiet hours and tell you in advance. Urgent security work may happen without notice.

  4. 7.4

    Support is available by ticket, live chat and email. It covers our platform and the Services you ordered. We help with third-party software where we reasonably can, and we will tell you before any larger piece of work would be charged.

Your content and data

It is yours, and you should keep a copy.

  1. 8.1

    You keep ownership of your Content. You give us permission to store, copy and transmit it only as needed to provide the Services.

  2. 8.2

    We take backups as described on your plan and restore from them where we can. Backups are a convenience, not a guarantee, so keep your own copies of anything important.

  3. 8.3

    Personal data is handled as described in our Privacy Policy.

  4. 8.4

    Before a Service closes, you can ask us for a full copy of its data.

Domain names

Registered in your name, under registry rules.

  1. 9.1

    Domains are registered in your name as the registrant and are subject to the rules of the relevant registry and, where applicable, ICANN or the relevant country-code registry.

  2. 9.2

    You must keep your domain contact details accurate. It is your responsibility to renew a domain before it expires. After expiry, a domain may enter a grace or redemption period, and the registry may charge a fee to restore it.

  3. 9.3

    You can move a domain to another provider by requesting its transfer code from the client area. Registry rules may prevent a transfer for a period after registration or a previous transfer.

Cancellation, suspension and termination

Leaving is easy; so are the rules for when we act.

  1. 10.1

    You can cancel any Service from the client area at any time, taking effect at the end of the current Term or immediately if you prefer. There is no notice period and no retention call.

  2. 10.2

    We may suspend or terminate a Service for non-payment, for breach of these Terms or the Acceptable Use Policy, to comply with a legal order, or where there is evidence of fraud. Where circumstances allow, we contact you first.

  3. 10.3

    If we decide to stop offering a product, we give you at least 30 days notice and either move you to an equivalent plan or refund the unused part of any fees you have paid in advance.

  4. 10.4

    When a Service ends, its data is deleted after the retention period for that Service, and any fees already owed remain payable.

Liability

Fair limits, stated plainly.

  1. 11.1

    To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose.

  2. 11.2

    We are not liable for indirect or consequential loss, including lost profits, lost business or lost data, except where the law does not allow this to be excluded.

  3. 11.3

    Nothing in these Terms limits any liability that cannot be limited by law.

  4. 11.4

    You are responsible for claims made against us that arise from your Content or from your breach of these Terms or the Policies.

Events beyond our control

Some things no host can prevent.

  1. 12.1

    We are not responsible for failures caused by events beyond our reasonable control, such as natural disasters, war, widespread power or internet outages, failures of upstream providers, or government action. We will tell you what has happened and restore the Services as soon as we reasonably can.

Changes to these Terms

We tell you first.

  1. 13.1

    We may update these Terms. Material changes are notified by email at least 30 days before they take effect, and you may cancel before then.

  2. 13.2

    If you continue to use the Services after a change takes effect, the updated Terms apply. The current version is always the one published on this page.

14

General

The legal housekeeping.

  1. 14.1

    These Terms, the Policies and the details of your order are the whole agreement between us. Where these Terms and a Policy differ on that Policy's subject, the Policy applies.

  2. 14.2

    You may not transfer your Account to someone else without our agreement. We may transfer these Terms to a business that takes over HostElevate, and we will tell you if that happens.

  3. 14.3

    If any part of these Terms is found to be unenforceable, the rest continues to apply. If we do not enforce a term straight away, we can still enforce it later.

  4. 14.4

    We send notices to your Account email address. You can reach us at support@hostelevate.com or by opening a ticket.

  5. 14.5

    These Terms are governed by the laws of the country in which HostElevate is registered, and the courts of that country have jurisdiction. Nothing in them limits any consumer rights you have under the law of the country where you live.
